1. License and service
AeroMailer grants you a limited, non-exclusive, non-transferable, revocable license to install and use the desktop software with the subscribed SaaS services.
The software is licensed, not sold. Features, usage limits, updates, and availability may depend on your subscription plan.
2. Acceptable email use
You may send only lawful messages to recipients who have provided valid consent or where another lawful basis permits the communication.
You must not use AeroMailer for spam, phishing, impersonation, credential theft, malware distribution, harassment, purchased or scraped address lists, or any deceptive or unlawful campaign.
You are responsible for sender identification, unsubscribe handling, suppression lists, records of consent, and compliance with applicable privacy, marketing, telecommunications, and anti-spam laws.
3. Accounts, credentials, and security
You are responsible for protecting your device, subscription account, SMTP credentials, API keys, and access to connected services.
AeroMailer stores supported secrets in the operating-system credential vault where available. No security method can guarantee absolute protection.
4. Subscriptions and payment
Paid plans may renew automatically until cancelled. Prices, billing periods, taxes, refunds, trials, and cancellation rights will be shown during purchase or in the applicable order terms.
If payment fails or a subscription ends, paid features or sending limits may be restricted without deleting locally stored data, subject to applicable law.
5. Data and privacy
You control the contact data, message content, templates, and credentials you add. You represent that you have the right to process and use that data.
Local data remains on your computer unless a feature clearly requires a connected provider or SaaS service. Connected providers process data under their own terms and privacy policies.
6. Third-party services
SMTP providers, AI providers, analytics services, operating systems, and other third parties are independent services. AeroMailer is not responsible for their availability, delivery decisions, limits, policy changes, or data handling.
7. Updates and changes
AeroMailer may provide security, compatibility, and feature updates. Material changes to these terms will require renewed acceptance where appropriate.
You must not bypass subscription controls, reverse engineer protected service components, interfere with security controls, or distribute modified builds as AeroMailer.
8. Disclaimer and liability
The software and services are provided on an as-available basis to the extent permitted by law. Email acceptance by an SMTP server does not guarantee inbox delivery.
To the maximum extent permitted by law, AeroMailer is not liable for indirect, incidental, special, consequential, or punitive loss, lost profits, lost data, blocked accounts, or provider actions. Any mandatory rights that cannot legally be excluded remain unaffected.
9. Suspension and termination
Access may be suspended or terminated for unlawful use, abuse, security risk, non-payment, or a material breach of these terms. You may stop using the software and cancel your subscription according to the applicable plan terms.
10. Governing terms and contact
These terms and conditions are governed by and construed in accordance with the laws of Copyright Act 1987 and the Cyber Security Act 2024 Malaysia.
Any disputes arising under these terms shall be resolved exclusively in the courts of Federal Court - Malaysia.
